土地发展权法律制度研究 （硕士论文摘要） 土地发展权起源于英国，是指对土地在利用上进行再发展的权利，即土地所有权人或土地使用权人改变土地现有用途或者提高土地利用程度的权利。它是从土地所有权中分离出来并且具有独立性和可移转性的财产权。土地发展权的产生有经济学、社会学、生态学和法哲学基础。在英、美、法等国家，土地发展权首先被用来平衡限制发展地区和可发展地区之间因为发展规划而带来的利益不平等，同时土地发展权制度还可以推进土地利用规划的实施，以更好的实现农地、环境敏感区以及历史古迹的保护等公共目的。我国经济飞速发展的同时也遇到了严重的环境问题，如农地流失、土地沙漠化等。其中重要的一个原因在于在土地利用和管理中对土地发展权制度的缺失。我国采物权法定主义，尚未对土地发展权做出规定。 本文通过对土地发展权的理论基础的介绍以及国外土地发展权的比较研究，论证我国创设土地发展权具有必要性和可行性：通过创设土地发展权，可以更好地激励农民保护农地；赋予农民集体土地发展权，可以保障农民参与土地增值利益的分享和实现，解决失地农民的收益补偿问题；可以完善我国土地所有权法律制度，解决当前土地发展权制度缺失造成的不良影响；更为重要的是，构建土地发展权法律制度，可以就当前形势下推动农村集体土地流转进行尝试。文章进而对构建与我国国情相适应的土地发展权法律制度提出立法建议。 文章主要包括： 一、对土地发展权理论的介绍和分析。 二、对世界主要发达国家（英、美、法等国）土地发展权法律制度的比较研究和分析。 三、对构建与我国国情相适应的土地发展权法律制度的立法建议。 [关键词] 土地发展权 法律制度 立法研究 Research on the Legal System of Land Development Rights Abstract Land development rights (LDR) originated in Great Britain, referring to the rights of using land for redevelopment, that is, the rights of the land-owner or land-user to change the existing land uses or to increase the extent of land-use. LDR is an independent and transferable property right which is separated from land ownership. The emergence of LDR was based on economics, sociology, ecology and the philosophy of law. In Britain, the United States, France and other countries, LDR is used to balance the inequality of the benefits between the restrict area and development area resulted from land utilization plans and accelerate the implement of land utilization plans in order to achieve public goals, such as conservation of farmland, environmentally susceptible area, places of historic interest and so on. China faces serious environmental problems with fast development of economy, such as loss of farmland, desertification and so on. The main reason is the loss of LDR in land usage and administrator legal system. China adopts the principle of Numerus clauses, but LDR has not been provided in Chinese law yet.
