论环境知情权摘 论环境知情权 摘 要 环境权是指环境法律关系的主体享有在不受污染和破坏的环境里生存的权 利，以及在一定程度上利用环境资源的权利。知情权是指法律关系的主体依法享 有的知悉、获得与法律赋予该主体的权利相关的各类信息的自由与权利。环境知 情权是指社会大众对本国乃至全世界的环境政策、环境保护现状、环境信息等内 容所享有的权利，这些权利包括知晓权、申请权、获得帮助及救济的权利等内容。 环境知情权产生之后受到了各国和国际社会的广泛关注。许多国家如美、日、英、 德等纷纷颁布了专门的环境法律、法规等对环境知情权作出规定，国际社会也不 例外。目前，我国的环境知情权立法现状为：《中华人民共和国宪法》中有关公 民知情权保护的规范、综合性环境保护基本法如《中华人民共和国环境保护法》 中有关环境知情权保护的规范、其他法律法规对于环境知情权保护的规定、以及 我国参加的国际条约等等。仍然存在着诸如：没有在法律中明确规定公民环境知 情权、政府保障公众环境知情权责任不明确等等许多的问题。所以，加强对我国 的环境知情权制度的研究具有重要的理论意义和实践意义。具体来说，可以从立 法等几个方面促进对于环境知情权的保障。 关键词：环境权；知情权；环境知情权 中南林业科技大学硕士学位论文Abstract 中南林业科技大学硕士学位论文 Abstract Environmental right means the subjects of environment legal relation have the fight to survive in the environment free form pollution and destruction and have the fight to use environment resources to a certain extent．The fight to know means the subjects of legal relation enjoy lawfully freedom and fights to aware and get all kinds of information related with legal rights of the subjects．Environment fight to know means the public enjoy fights to environmental policy，environmental protection status，environmental information in their country and the world．These fights include the right to know，get help and relief．Environmental information realization way of environment refers to duty part of active and passive public information publicly both forms．Environmental information generated by the countries after the attention of international community．Many countries，such as America,Japan，Britain，Germany， ere．In succession issued special environmental laws and regulations on environmental information stipulated that the international community is 110 exception．At present our country environment right legislation in the constitution for：about the protection of citizens’right to regulate，comprehensive environmental protection in the basic law on environmental information protection of norms，other laws and regulations for the protection of environmental information as well as our country provisions，according to the
