摘 要 刑讯是一种野蛮的诉讼取证手段，是中国诉讼制度中的传统。刑讯逼供演奏 侵犯人权，践踏法治尊严，与司法文明背到而驰。因此要坚决遏制刑讯逼供现象 的发生。 论文主要分为三个部分：第一部分对刑讯逼供进行概述，主要讲解了刑讯逼 供的概念，刑讯逼供的性质；第二部分研究了刑讯逼供问题的危害，并从五个大 的方面分析了刑讯逼供问题的产生原因，包括：思想观念陈旧，经济和技术落后， 部分办案人员政治业务素质低，缺少应有的职业道德，侦查活动隐蔽，查处司法 人员刑讯逼供违法犯罪力度不够；第三部分主要从培养现代司法理念，确立与完 善诉讼程序规则和完善法网规制三个大的方面分析了用制度制约刑讯逼供的对 策。 关键词：刑讯逼供；司法文明；法律制度；诉讼程序 Abstract Torture is a barbaric action means evidence,Is the traditional litigation system.
