残疾儿童的受教育权法律保障研究 【摘要】 受教育权是我国宪法规定的基本权利，残疾儿童和非残疾儿童应当同样享有这一项权利。虽然我国在残疾儿童受教育权利 方面取得一定的进步，但是残疾儿童受教育权的法律保障情况还是不容乐观。立法保护是残疾儿童受教育权的起点，因此，本文在借 鉴他人的研究成果的基础上，对我国残疾儿童受教育权的立法保障问题展开研究。在第一部分中，本文主要介绍残疾儿童受教育的背 景和本文需要研究的问题，引导下文进行深入的研究。在第二部分中，本文围绕着残疾儿童受教育权的立法现状总结目前残疾儿童受 教育权立法保障的制度困境：专门性立法和配套体系不完善、法律规定可操作性差、义务主体不明晰、法律责任和救济程序不完善。 在第三部分中，本文主要介绍了境外的残疾儿童受教育权法律保障的经验：美国的残疾儿童受教育权保障、日本残疾儿童受教育权保 障、台湾地区残疾儿童受教育权保障。在第四部分中，本文结合境外的残疾儿童受教育权的保障经验，根据我国残疾儿童受教育权立 法保障的现状作出相应的建议：更新立法理念、修改完善现有法律、制定专门性法律、解决教育滞后性问题。 2【关键词】 残疾儿童，受教育权，立法 Research on the legal guarantee of the right to education of disabled children 【Abstract】 The right to education is the basic right stipulated in the constitution of our country. Disabled children and non disabled children should enjoy this right as well. Although China has made some progress in the right to education of disabled children,the legal protection of the right to education of disabled children is still not optimistic. Legislative protection is the starting point of disabled children's right to education. Therefore,based on the research results of others,this paper studies the legislative protection of disabled children's right to education in China. In the first part,this paper mainly introduces the background of disabled children's education and the problems that need to be studied in this paper,and guides the following in-depth study. In the second part,this paper summarizes the current situation of the legislation of the right to education of disabled children and summarizes the institutional dilemma of the legislative protection of the right to education of disabled children:the imperfect specialized legislation and supporting system,the poor operability of legal provisions,the unclear subject of obligations,the imperfect legal responsibilities and rescue procedures.
