婚姻第三者侵犯配偶权民事责任研究 【摘要】我国《婚姻法》规定了离婚过错损害赔偿制度，然而该条法律规定仅针对过错配偶提出，从侧面说明了第三者不需要承担民 事责任。所以至今对于第三者侵犯配偶权的行为民众也只能对其进行道德的谴责，这使得第三者插足他人婚姻的现象频频发生，不利 于家庭的稳定和社会的和谐。在借鉴境外对于第三者侵犯配偶权行为的态度和法律规定的基础上，结合我国侵权行为的构成要件以及 民事责任，明确第三者侵犯配偶权行为属于侵权行为，确定第三者责任承担范围和健全无过错配偶的取证制度。此有利于我国婚姻立 法的完善，保障了婚姻关系的稳定和社会的和谐。 【关键词】 配偶权，第三者，侵权，民事责任 Research on Civil Liability of Third Party in Marriage for Infringement of Spouse Rights 【Abstract】Chinas marriage law stipulates the divorce fault damage compensation system, but this law only applies to the fault spouse, which from the side shows that the third party does not need to bear civil liability. However, this law only applies to the wronged spouse, which means that the third party does not need to bear civil 2liability. Therefore, up to now, the public can only condemn the behavior of the third party violating the rights of the spouse, which makes the phenomenon of the third party interfering in the marriage of others happen frequently, which is not conducive to the stability of the family and the harmony of the society. On the basis of drawing lessons from overseas attitudes and legal provisions on the third partys infringement of spouses rights, combining with the constitutive requirements of tort and civil liability in China, the third partys infringement of spouses rights is defined as tort, the third partys liability scope is determined and the evidence collection system of no-fault spouse is improved.
